Correction: courts will tear it up IF AND ONLY IF the courts in question aren't full of Republican-appointed judges.
It doesn't matter if something is outrageously unconstitutional; judges are who dictate what laws get to stay in place and Republican judges couldn't care less about their rulings making logical sense. After all, why should they? As long as you can get people to vote for you, you don't need to make any sense.
