The wording mentions ICAO. I wonder if they're backtracking because of the six month rule. Many countries require those entering to have passports that will be valid for at least six months. If the State Department can invalidate passports whenever it wants, then that could cause problems for all Americans traveling, not just transgender Americans.

There are a lot of challenges, but yes, I think the six month rule likely plays a part. The prospect of Americans being in another country and having their passports invalidated would encourage Americans to stay where they are.

Obviously in the way they make decisions without understanding the repercussions, we’re going to see more of this kind of situation…. That’s what happens when you bring in disrupter style management and fire the experienced people. Three more years of this at least…

KM's avatar

No, but it's a good sign that they don't feel confident enough to do it their evil plan openly.

the cost of going around invalidating passports would be immense, and when they started fucking it up (as they do with 100% of the things they attempt) they would call into question the validity of all american passports, and that would be a large loss for wealthy americans. They can't really fuck with that, especially without any legal authority to do so.

Great! Now we have I hope no more than Jan 20th 2029 to find out if that holds.

Sooner is better. [IMPEACHMENT!, for all of them!]

Hahaha, looks like the Almighty State Department has contracted “TACO” Disease!!

I just recently applied and got my passport with my correct gender in less than two weeks. I suggest that all in the trans community get their passports because by the time our passports expire and are ready for renewal, I predict that MAGA will not exist anymore, at least not in its present form! Once Trump is dead and gone, and the Afterparty is over, I believe that cult will destroy itself even further and the evangelical religious cult will die out as well! That will be another Boon to society! The sooner this government collapses the sooner we can get on with creating a True Social Democratic Government, FOR THE PEOPLE AND BY THE PEOPLE! FDT! FJDV! AND FUCK THE TRUMP REGIME!!! 🏳️‍⚧️🏳️‍🌈

Once again the administration's cruelty is matched only by its incompetence.

I'd like to think that this is a good sign, but it's probably due to the fact that they've lost too much personnel to invalidate all the passports at once.

They were testing the waters and decided the temperature wasn't just right. That's all. Whether because the GQP is currently feuding with itself over the Epstein files, or because one too many eyes were looking their way... but the moment they feel secure in their power again, watch out.

This is very good news (Erin, as always, thanks for reporting), but it is still a huge problem that the state department wants to revert sex/gender markers on the next renewal, even if for many people that’s eight to ten years from now. All trans advocacy organizations should be working hard in courts and with their representatives to convince the passport people not to do this. Wrong markers, especially for biologically female people (i.e. those who are fully transitioned and have had surgery) place them at great risk when traveling. Having birth sex on a current passport makes no sense.

April Razz's avatar

let's not use the language of transphobes (biologically __) to make distinctions between groups of trans people. looking like a woman and being pre-op for example doesn't put you at any less risk of violence if you come under scrutiny.

otherwise you could use your same logic maliciously to imply it'd be bad to give correct markers to transmascs who aren't far enough along in their transition to stay under the radar.

which is exactly a way that the supreme court argued to defend their decision, in fact.

Susan Tuzzolino's avatar

And what happens after they expire?? And don't folks renew their passports before they expire? What happens then?

Sarah F's avatar

They issue the new one with sex assigned at birth.

Way to keep people off-balance.

Joanne C. Mahlmeister's avatar

Exactly this... and after the wording changed 3 times in a weeks time, I am very unbalanced.

Nancy's avatar

It's just so unnecessary and traumatizing.

This is great news if indeed it holds true. Unfortunately for those who where not fortunate enough to get a new passport this will not help. My hope however is that after the election of 2028 we get a new president who will realize the reality of life and put into effect a law allowing people who want to adjust their passports that right. However we must never stop striving to get what is a right.

Celeste Irwin's avatar

A win is a win, right? Even if it sounds like their hand was forced, this provides much needed stability. Now if only we could get them to reinstate getting new passports for all trans and non-binary folx!

Assuming they don’t change their mind again , this is a huge relief.

Bureaucratic backlash and the smooth implementation of any constantly in flux policy. Meaning assholes in the bureaucracy can feign ignorance to cover up being illegally mean.

Howard Hutton's avatar

I guess what I mean is when you travel carry a printout of the DOS fact page that you’re passport is good or have a link ready that you can easily get to

Stacy Dudovitz's avatar

Expiration date is still putting a "Sell by" date on us to decide to stay or leave the country, especially for those of us that well into our current 10 year passport. It's not just passports, what happens to Medicare/Medicaid, Real ID, SSA Retirement and Disability, IRS/Tax Related... this entire act of pointless cruelty puts us in legal limbo.

I don't trust this administration, they change the rules from one minute to the next.

I give you as exhibit A:

"The Epstein files are on my desk"

"There are no Epstein files"

"We already released the Epstein files"

"Trump doesn't want any of the Epstein files released"

"Trump is pushing Republicans to release the Epstein files"

Pick your poison. 😡

The NYT published its story concerning this and the comment section was a complete shit show. The mods apparently couldn't decide if the nazis and eugenicists' comments should be allowed for the purposes of civil discourse and free speech, or they should be disallowed for the sheer nastiness of them all. Some got posted and pulled after an outcry. I hate the NYT for all of the things they have done in the past few years to stoke fears around gender affirming care and trans teenagers under the guise of "educating the masses", and just watching the posting of the passport article and the comment section reaffirms for me that somewhere in that giant organization is a group with an anti-trans agenda, barely masquerading as progressive organization.

I looked back at my first passport when I was two years old and heading to Germany with my parents. I am sitting on my mom's lap. No gender/sex designation - just name, age, hair and eye color. The US State Dept and the Army apparently didn't care what my gender was at birth...why care now.

Marius's avatar

The NYT, like most big media orgs, has just become a tool for the structures of power in place. They will parrot anything they perceive as popular or controversial, all for the money. This naturally allows hate to foster because nothing is forbidden, nothing is moderated so every hateful kind of content has a place in their pages as long as it sells. Because at the end of the day the organization as a whole does not care what is being said, so long as it makes money.

To put it another way, this is simply the result of tolerating intolerance, aka the Nazi bar problem. And the NYT is the bartender who accepted to serve the Nazi simply because they valued the Nazi's money more than they cared about resisting fascism.

Thanks for your thoughtful reply. I agree with you on all points, and I am sure that other people in marginalized groups have had to endure the pain that mainstream, capital-driven media organizations continually cause. I suppose I am ranting about this because my beloved child is directly harmed now and likely into her adulthood by institutions repeatedly posing as advocates and allies at one time and then flipping when it is convenient. I am a high school teacher whose student population over the years has become more international, more vulnerable, and decidedly more gender expansive. I desperately want and hope that we step up as humans to stop tolerating intolerance for the sake of the almighty dollar, and start protecting all humans with dignity and compassion.
