I take so much joy in Republican passed amendments after ACA passage being why they can't ban trans healthcare.

Like they were misguided in their reasoning to originally pass the amendment, but they weren't actually bad amendments for the most part. Healthcare access should be protected. More so we should be fighting for universal healthcare.

And now I get to giggle every time one is used against them.

Yeah, I enjoyed that too and agree on it's face that it was a good amendment even though the motivation was misguided.

These judges really laid it all out well and exposed this jackassery for what it is. I so wish this could be the last word on all of it.

This had me howling with laughter all the way down I-80 this afternoon.

My state of Wyoming had the same thing happen to them when they tried an abortion ban a few years back. They already had a "healthcare freedom" constitutional amendment to f*** with Obamacare and it got thrown back in their faces by the judge when they tried to follow the MAGA's and institute a highly restrictive abortion ban.

I think they just passed a GAC ban as well, hopefully the Ohio case is cited as precedent when it gets challenged in court.

I know it may seem kinda callous to be laughing at this - I know its deadly serious for trans people across the country rn - but you gotta love the irony of the Republicans accidentally protecting healthcare freedom cause they hated the ACA so much. Thanks bunches, you old white bastards!

I love this ruling, but I worry. We live in a time when elements of the Trump Administration feel they can freely ignore the ruling of a federal judge about as bedrock a Constitutional issue as due process. And, much like all the "protections" for women's health that actually are attacks on them, I deeply fear that this ruling will be subjected to a typical "death by a thousand cuts" approach. Take the victory lap, by all means! It's a wonderful ruling. But don't for one instant think it settles this matter.

Trump and Republicans have done us one favor. They've shown a lot of people that the system only works when we work to make the system better.

Laws and judicial rulings are malleable by those in power. We have to work to keep honest and fair people in power.

Republicans worked for decades to stack SCOTUS in their favor to get a Roe ruling and many other rulings in their favor. They worked the grey areas of what is legally allowed to get what they wanted.

Lots of systems were based on a "gentleman's agreement" and even then, an illegal action is only illegal once a court says so and an enforcement mechanism is in place.

DAMN, I NEEDED THAT! :-D I especially enjoyed the takedown of that transphobic freak James Cantor. Oh, and the Ohio constitutional amendment - PRICELESS!

What I'm wondering is this: If they could invalidate the trans healthcare ban on the basis of the amendment, why couldn't they do the same for abortion? It seems the same arguments would apply.

That's a good question. Here's what I found -

So, it looks to me like Ohio tried to pass an abortion ban and failed because the Ohio constitution has an amendment specifically about reproductive right.

I'm from Wisconsin, and damn, I wish we have Ohio's constitution! Fortunately we have a Democratic Governor so abortion bans and anti-trans bills aren't becoming laws, but if that power balance shifts in the future, our constitution doesn't have protections that are as explicit.

I think Ohio still has abortion restrictions, possibly that the constitutional amendment didn't cover - abortion after 20 weeks, for instance. I remember when Ohioans turned out in overwhelming numbers to pass the constitutional amendment. It was a good day! :-)

It just seems to me like this constitutional amendment banning restrictions on medical care and health insurance could be used to tear down the remaining restrictions, for instance if a woman suffers a late-term miscarriage. Anyway, I'm sure this has occurred to the ACLU already. (Fantastic organization! It's quite satisfying to contribute to them, because I see tangible results from them every day!)

Hooray for Ohio! The same bill is being voted on in committee in NH tomorrow. I will run off copies of this and bring it to the hearing tomorrow. It's an executive session, so I can't testify. But I will talk to each of them on the way in. (Although the sponsors refuse to talk to me, or even look at me.)
