Biden's new Title IX regulations were just released on the heels of a win in the Supreme Court. These regs miss the mark and could be used to fuel more anti-trans sports bans.
Have democrats really not figured out that people even further to the right of them will label them as extreme leftists who want to perform genital surgeries on kids no matter WHAT they do? Like, I honestly can’t understand they don’t just go all in on trans rights. Who is this actually appeasing?
Honestly, the ineptness of it all hurts almost as much as the transphobia. They threw trans kids under the bus for… nothing. No concessions whatsoever.
To be fair, at least one significant thing that Biden did for trans rights was to allow us to select whichever gender marker we choose when getting our passports, without the humiliating "physician's certification" that was required before. It's actually a pretty big deal, because in many places in the world getting documents with the correct gender marker is nigh impossible. This doesn't defend anything, but it's far from nothing.
He allowed that but in practice that's not what actually happens in some passport offices. I just renewed mine (appointment for travel in 13 days or less) and they demanded a court order for me to update my gender marker. I argued with them stating that is not done in GA and that it is no longer required as its self identify. They continued to tell me that without it they would not be updating my gender marker. At that point I told them that my gender marker was updated on my GA DL so they asked to see that as proof and then disappeared for about 5-10 minutes. I left in tears and spent all day terrified I'd return to collect a passport with the wrong gender marker. They updated it, but had my DL not been updated they would not have updated it.
so just because the executive branch has stated it, doesn't mean in practice it is actually happening.
The problem with Biden is not that he doesn't care about us trans folk, but he is of the generation where he feels a compromise is always the solution - there are certain things where compromise is giving up your position and conceeding, what a terrible thing.
First he busted the rail union, now he’s busting trans rights. This is exactly why so many progressives distrust him, but we had to vote for him anyway because the other option was significantly worse. Way too many supposed dems/liberals are a-ok with transphobia and homophobia and will cheerfully throw us under the bus to get their cash payout from the hate group lobbyists. This latest maneuver also shows way too many will cozy up to fascism and have no problem ushering it in as long as they get to keep their wealth and aren’t the target du jour. This won’t stop with the unions or trans rights, either. They’re going to help the christofascists by further eroding the rights of the BIPOC community, poor people, women, and on and on; basically anyone who isn’t the “correct” type of white, Christian, rich male.
The win at SCOTUS yesterday isn't really a win unfortunately. I'll take them where we get them, but when you read the opinion the reason for allowing the injunction to stay is the duration that WV waited (18 months). So this in no way indicates how SCOTUS will rule when this type of case is heard before them. Based on the Dobbs v. Jackson opinions, SCOTUS will uphold trans sports bans. The Fourteenth Amendment was passed in 1866, Title 9 was passed in 1972, and WPATH was founded in 1979. The first recorded usage of transsexuality was in the Oxford Dictionary and said it is a rarer synonym for homosexuality. I'm calling out these dates because the majority opinion in DvJ speaks explicitly to abortion laws going back in time. I see equal protection being skirted via "they can already participate in sports." Medical restrictions I don't know about as there isn't much within opinions released that would touch on this.
Biden's new Title IX regulations will only add fuel to the fire in front of SCOTUS. And more importantly it's not that it feels like a betrayal; it is one. My guess is this is only being framed as a "compromise" and is driven by internal polling that indicates that there are enough democrat voters that would not re-elected him because of this and that it could sway some republicans that do not like the GOP presidential nominee to vote for Biden instead of not voting at all.
We've watched this play out now for 6 years. The democrats continue to shift right to not appear so "left" and they are almost at the center point. I suspect that over the next two years we will see a party shift on trans rights with only a few outliers that remain supportive of the trans community in all manners. I don't like being a debbie downer, but we've seen this movie before.
When he didn't say anything about transphobia in the State of the union I knew he didn't really care. Democrats are just like the people that let Hitler rise to power.

Now schools will have the ability to use this for their own discrepancy; no matter whether they fully understand transgender processes or not. Where is the line? What sport is deemed too dangerous? What happens when the child has not gone through their biological puberty but that of their actual gender identity?
There are 2 schools in my county in PA that have lawsuits either pending or forthcoming because of Title IX violations, and after this it’s going to spread like wildfire through out the rest of the districts because Biden just handed them the golden ticket for discrimination. I’m absolutely furious right now, and also scared for the youth we’ve been helping, including my own tween who is trans. We’re in the red area of PA where christofascists are infiltrating everything, especially at the local level where they can quickly gain power and cause a ton of damage. This is causing massive amounts of harm for our kids, and any dem/liberal trying to play to both sides is showing us how little they care, and how little of a liberal they are. They’re not liberal or progressive, they’re conservative-lite, and they don’t really care about what we the people want or how it affects marginalized populations; they only care about themselves and would be ok with seeing us gone if it means they can preserve themselves, their status, and their wealth.
I thought the right wingers whole thing against youth transition, etc was to Do No Harm. so interesting to see Biden's "compromise" says to Minimize Harm.... Biden has been a disappointing embarrassment the whole time he's been in office, and sadly this is not a surprise to me.
I'm trying to find out where I can submit a public comment on the proposed rule but am having a little trouble navigating the Federal Register. Can anyone point me in the right direction?
