Biden's new Title IX regulations were just released on the heels of a win in the Supreme Court. These regs miss the mark and could be used to fuel more anti-trans sports bans.
Have democrats really not figured out that people even further to the right of them will label them as extreme leftists who want to perform genital surgeries on kids no matter WHAT they do? Like, I honestly can’t understand they don’t just go all in on trans rights. Who is this actually appeasing?
The problem with Biden is not that he doesn't care about us trans folk, but he is of the generation where he feels a compromise is always the solution - there are certain things where compromise is giving up your position and conceeding, what a terrible thing.
First he busted the rail union, now he’s busting trans rights. This is exactly why so many progressives distrust him, but we had to vote for him anyway because the other option was significantly worse. Way too many supposed dems/liberals are a-ok with transphobia and homophobia and will cheerfully throw us under the bus to get their cash payout from the hate group lobbyists. This latest maneuver also shows way too many will cozy up to fascism and have no problem ushering it in as long as they get to keep their wealth and aren’t the target du jour. This won’t stop with the unions or trans rights, either. They’re going to help the christofascists by further eroding the rights of the BIPOC community, poor people, women, and on and on; basically anyone who isn’t the “correct” type of white, Christian, rich male.
The win at SCOTUS yesterday isn't really a win unfortunately. I'll take them where we get them, but when you read the opinion the reason for allowing the injunction to stay is the duration that WV waited (18 months). So this in no way indicates how SCOTUS will rule when this type of case is heard before them. Based on the Dobbs v. Jackson opinions, SCOTUS will uphold trans sports bans. The Fourteenth Amendment was passed in 1866, Title 9 was passed in 1972, and WPATH was founded in 1979. The first recorded usage of transsexuality was in the Oxford Dictionary and said it is a rarer synonym for homosexuality. I'm calling out these dates because the majority opinion in DvJ speaks explicitly to abortion laws going back in time. I see equal protection being skirted via "they can already participate in sports." Medical restrictions I don't know about as there isn't much within opinions released that would touch on this.

My guess is this is only being framed as a "compromise" and is driven by internal polling that indicates that there are enough democrat voters that would not re-elected him because of this and that it could sway some republicans that do not like the GOP presidential nominee to vote for Biden instead of not voting at all.
We've watched this play out now for 6 years. The democrats continue to shift right to not appear so "left" and they are almost at the center point. I suspect that over the next two years we will see a party shift on trans rights with only a few outliers that remain supportive of the trans community in all manners. I don't like being a debbie downer, but we've seen this movie before.
When he didn't say anything about transphobia in the State of the union I knew he didn't really care. Democrats are just like the people that let Hitler rise to power.
I, too, feel betrayed. It’s like he’s trying to play both sides and this will make it worse.
Now schools will have the ability to use this for their own discrepancy; no matter whether they fully understand transgender processes or not. Where is the line? What sport is deemed too dangerous? What happens when the child has not gone through their biological puberty but that of their actual gender identity?
I thought the right wingers whole thing against youth transition, etc was to Do No Harm. so interesting to see Biden's "compromise" says to Minimize Harm.... Biden has been a disappointing embarrassment the whole time he's been in office, and sadly this is not a surprise to me.
I'm trying to find out where I can submit a public comment on the proposed rule but am having a little trouble navigating the Federal Register. Can anyone point me in the right direction?
