The ruling by Trump-appointed judges contradicts other classroom speech cases and is a clear case of the state barring disfavored speech, according to the dissent.
Is that teacher a veteran? I’d make the kids call me by my rank! Instead of she/her/hers, or Mr/Ms Halo, it’d be ,the Corporal, the Corporal, the Corporals, Corporal Halo!
I mean she could just ask them to call her 'teacher', but her freedom of speech is still lost. Her first amendment right is still trampled by brasher and newsom, who should both be disbarred for this blatant violation of the constitution.
"Teacher Smith" was the first thing I thought of as well. Of course it's stupid and wrong we even have to have this discussion, but as Zoe says, at least it subverts the goal of the law in a visible way.
I can’t do anything about the courts ruling to infringe. I can however be that bitch who robs the bigots of their win by not giving them what they want. Focus on what you CAN do, not what you wish someone else did. Because at the end of the day, the only control you have is what YOU do.
Time for someone to sue over something super petty like a teacher wearing a cross on a necklace while leading a classroom. If free speech doesn’t reach the classroom for us educators…then nobody gets it as the dissenting judge pointed out.
The contrast between the 6th Circuit and 11th Circuit rulings that Judge Jordan refers to is a great example of Wilhoit's Law:
"Conservatism consists of exactly one proposition, to wit: there must be in-groups whom the law protects but does not bind, alongside out-groups whom the law binds but does not protect."
While Wilhoit's Law is somewhat of an oversimplification, it most definitely is one of the core tenants of conservatism, and one of the reasons why it is evil on a fundamental level.
Though this ruling is indeed extremely transphobic, it's not just about transphobia. It's about hierarchy - specifically patriarchal hierarchy. One of the reasons conservatives hate us so much is not merely because they believe we're deviations from "God's will," "the laws of nature," or whatever BS they're spouting. It's because trans people gaining visibility, rights, and legal recognition goes against the rigid gender hierarchy they love so, within which there are no allowances for nonconformity of any kind. One of the primary reasons conservative groups exist is to crush nonconformity.
Honestly, I think that portion of Judge Jordan's dissent should be one of our go-to things we cite showing how logically and morally absurd conservative views on gender are. This ruling is despicable and causes real harm, but our enemy also unwittingly handed us ammo we can use against them. Which we absolutely should.
This is straight up bullshit. I hope she quits and moves to a state that respects her. Every state needs teachers. Even Florida, and they are gonna start needing them worse with these and other stupid and hateful laws
I'd drop the "not legally allowed" part, but yeah, definitely an introduction by name and title of "Teacher." A nice touch would be getting a desk nameplate with her name but no title.
Now we are going to require teachers to sin by misgendering themselves. The Spirit of God does not misgender transgender people so neither should we be requiring them to do so. These judges got to stand before Jesus one day so they better have an answer for him.
The next case should be framed as "My Christian faith teaches me that I am as God created me, both in body and gender. Forcing me to misgender myself is a violation of my religious freedom."
Seems the only way to get rights recognized these days is to claim religious, specifically Christian, violations of them.
Unfortunately, in the eyes of the people we're talking about here, the only people who deserve "religious freedom" are CONSERVATIVE Christians, and SOMETIMES other conservative religious groups, but ONLY when it comes to issues on which they align with the conservative Christians. The only reason conservatives gave a shit about Tamer Mahmoud and Enas Barakat was because they're nasty bigots who share conservative Christians' hatred of LQBTQ+ people.
In other words, these people tend to view religious liberty much the way they view the concept of freedom of speech.
Agreed to the point that so far, it's been (at least overwhelmingly if not invariably) right-wing Xians who have been making the claims and SCOTUS is pro-Xian nationalist. That doesn't mean that others should forego using the same argument for a better purpose, calling the others out for their hypocrisy in the course of it.
There is merit to that. Calling out hypocrisy is always a worthwhile endeavor, and drawing attention to the (frequently cruel) hypocrisy of conservative Christians is important - especially in the long term.
I've been saying for some time now that it's important to play the long game and think beyond simply mitigating harm and winning the next election. The latter two matter, certainly, but one of the ways we win in the long term and actually build a better future is by tearing down institutions that are keeping the horrors from the past alive, brick by brick.
Some institutions get away with terrible things because they are a dominant force in society and are seen as inherently good, and thus people are less likely to examine them critically. Chip away at the mask enough though and more and more people will see these things for what they are.
FFS. This is such an egregious ruling. They just want to erase everybody and everything they don't like. Ugh!!!! I hate fascists with the white hot passion of a thousand suns!!!
Another thought on this would be for someone in the FL lege to introduce a bill to amend the law to change references to "sex" to "identity as established by their birth certificate."
It would go nowhere, of course, but because the only actual difference would be that the restriction would apply to people other than trans folks*, itwould serve as a means to push and amplify the point that this is blatant state-sponsored speech control.
*For example, it would require married female teachers to use their maiden names and bar them from using "Mrs."
Is that teacher a veteran? I’d make the kids call me by my rank! Instead of she/her/hers, or Mr/Ms Halo, it’d be ,the Corporal, the Corporal, the Corporals, Corporal Halo!
A perfectly genderless pronoun/honorific!
I mean she could just ask them to call her 'teacher', but her freedom of speech is still lost. Her first amendment right is still trampled by brasher and newsom, who should both be disbarred for this blatant violation of the constitution.
I agree. But at least my solution and yours thwarts the goal of the law which is to make trans people uncomfortable.
"Teacher Smith" was the first thing I thought of as well. Of course it's stupid and wrong we even have to have this discussion, but as Zoe says, at least it subverts the goal of the law in a visible way.
Or change her first name to Mrs.
I actually was joking about changing my first name to Miss. Middle name would be Zoe Jane.
As cute as that is it completely ignores the problem of infringement on her first amendment rights.
I can’t do anything about the courts ruling to infringe. I can however be that bitch who robs the bigots of their win by not giving them what they want. Focus on what you CAN do, not what you wish someone else did. Because at the end of the day, the only control you have is what YOU do.
Florida is outrageous. Fascism central.
Please leave Florida and come to California -- we desperately need good teachers and I promise your soul won't be stripped away!
Time for someone to sue over something super petty like a teacher wearing a cross on a necklace while leading a classroom. If free speech doesn’t reach the classroom for us educators…then nobody gets it as the dissenting judge pointed out.
GOPSCROTUS ruled earlier this term that freedom of religion is the most important right in the Bill of Rights (Mahmoud).
Boycott Florida: no conferences; no vacations; no products made or grown in Florida.
Done! We haven't traveled there in 3 years since things became really bad.
Students should misgender all the teachers and make it "Opposite day" but forever until these stupid fucking laws go away
Just when you think the Trump regime has set the standard for cruelty and fascism, Florida says, "Hold muh beer!"
Every. Fucking. Time.

What if the teacher just avoids naming or gendering themselves?
Hi, I'm your new teacher. I'm legally not allowed to tell you my name, pronouns, or honorifics, so please just call me Teacher.
I'd drop the "not legally allowed" part, but yeah, definitely an introduction by name and title of "Teacher." A nice touch would be getting a desk nameplate with her name but no title.
Consider it a form of "malicious compliance."

All excellent points!

Did they think about the kiddos? Difficulty they’ll have… Just unfair for all involved and another wonderment from this Trump Supreme Court…
You forgot to use the honorifics for the judges. "The Shitstain Andrew L. Brasher The Bootlicker Kevin Newsom. "
Another thought on this would be for someone in the FL lege to introduce a bill to amend the law to change references to "sex" to "identity as established by their birth certificate."
