This is great news. I will take good news whenever we can get it these days. Hopeful that judges in other jurisdictions see this reasoning also. Bathroom bans are among the starkest evidence of the hatred and bigotry that prevails against trans people by many GOP politicians.
It's so easy to get caught up in the maelstrom of malevolent actions coming from MAGA. Glad to see state and federal judges stand up to this nonsense and file it all in the circular file bin.
The governor flat out ignored the testimony of transgender citizens & made HIS decision based off of effing Riley Gaines & ADF! His animus toward trans ppl is plain as day. The ‘guilty before proven innocent’ political trend needs to come to a screeching halt.
More good news! Truth is that such legislation is a waste of our time and our money. I wonder if the concept of frivolous lawsuits can be brought to bear upon frivolous legislative proposals? That’s the job of courts, I suppose.
We knew logic would prevail. Good. Thanks for all the updates, Erin & Crew. Sending lotsa love to Erin, Zooey, and Everyone from London, Ontario, Canada.
This is great news. My dream/wish is that at some point women will be women and not include the word "trans." At my age I doubt if I will see it but hopefully others will. That cis men will be identified as the problem to deal with when it comes to the safety of women.
The only time I describe myself as a "trans" woman is when it is necessary to discuss or clarify my trans trajectory. I look forward to the day when absolutely nobody will care about that trajectory - when it will be no more important (or no more anybody's business) than whether my sons were circumcised. At that point, when there is no more need to talk about it, then I will just be "a woman."
I wish people (even you Erin) would quit framing this as an attack on trans people when clearly it is an attack primarily on trans women. I honestly don't think the majority of men ever worry or even think about encountering a trans man in the bathroom. Or on the sports field for that matter.
Well, I think solidarity is important here. An attack on one is an attack on all.
Yes, trans women are the primary target of sports bans and bathroom laws, but these attacks are components of a much broader attack on all trans people (i.e HRT bans, military ban, passport ban, etc.). And, if trans men use the legally required bathroom in states with these laws they are far more likely to face violence.
It's a mixed bag of issues that we're all caught up in.
Yes, you're right it's about a broader attack on us all, but it just seems to me that it is more narrowly focused on trans women because they can use the rhetoric of " protecting women " to play on people's (read " mens") emotions. I suppose I could have been a little clearer about that, but just yesterday I watched a video by a young woman who got fired from Walmart because she was followed into the bathroom by a man who thought she was trans and she of course isn't. They fired her because they said SHE was a security risk to her fellow employees and to customers, not him. I have yet to hear a story of a trans man, or any man being challenged in this way in a mens room. Of course I support all trans people in the struggle for recognition and acceptance, and I know trans men are being ostracized as well, but the focus is still mainly on trans women. Besides being a trans woman myself I have a non binary grandchild who I love very much who lives in Alberta, our own little piece of maga heaven in Canada. They have followed the lead of the U.S. and have pretty much outlawed being trans there. I especilly feel for these children who are being denied life saving medical care for no rational reason by these mindless, heartless right wingers. I honestly can't understand the rabid hatred coming from these vile people.
That's awful about the Walmart employee! I hadn't heard about that, and after reading your comment searched and found several articles, such as this one -
Coincidentally, if you scroll down, the 2nd article on the page is titled "Outrage follows after Texas gay campground doubles-down on banning transgender men from property"
Also, this article is about a trans man who was beaten by people in a campground for using the women's restroom, which the campground owner had told her to use, and then when the police showed up she was arrested.
I've also heard trans men also talk about some pretty awful experiences they've had in the waiting room at the Gynecologist office. Many of them still need that care. As trans women at the Gyno's office, we can blend in. They can't and to ignorant people they do not look like they "belong" there.
I agree with you that the rhetoric of "protecting women" is a major theme and yes that is being aimed at trans women. I think it's important talk about that in a strategic sense, like analyzing the attacks being levied against us and how to defeat them.
I just think it's very important when doing so to be very clear that some of the hate out there is experienced differently, but we're not keeping score, we're in this together and an attack on one is an attack on all.
I also love the precedent for having to prove the BS expectation harm (in this case against women) that a bill is purporting to prevent. Lying asshats. So pumped for this win!! Bringing the bro dad energy today! Woooooo! Thanks Erin in the Morning Crew!
May this kind of logic prevail in the other states! 👏🏻👏🏻
After the arrest in Florida, this gives me the slightest glimmer of hope. Not done til we're all equal, all safe.
that arrest shook me to my core ~ I cried all night!
Me too. Me too. :(
I hope this ruling gives the Florida judge(s) precedent to drop the charges against this girl.
I'd like to think Florida judges have any backbone to do what is right, but my optimism doesn't extend that far.
“The judge also ruled that the ban relied on an unscientific definition of sex that effectively barred intersex people from using any bathroom at all“
Yes, many of us can honestly say “damned if we do, and damned if we don’t”.

Absolutely, sister! Thanks for being an ally.
It's not all bad news.
Excellent
Well shit, Montana is a rollercoaster.
This truly is the decade of mood whiplash.

Yeah, so glad they didn't buy into the "trans injury exception" (the term coined by Erin) that the 9th Circuit did.
