We have to work to challenge unconstitutional laws, and to have a Supreme Court that will uphold the Constitution. I would like to believe the Court will rule the right way, but given what happened with the abortion precedent being overturned, I can't bet on it. Trans rights are on the ballot, in presidential and senatorial races.
One of the important take-home messages from Erin’s maps is that a state’s status REALLY matters. What I mean by that is that nearly every light or dark blue state has maintained or even increased its degree of protectiveness over the past year - while the vast majority of reddish states on the map have only gotten worse. Even momentarily hopeful situations in such states l(e.g. Louisiana) have found a way to quickly turn around. Maybe I’m just re-phrasing Erin’s article, but...past performance does seem to strongly influence future results. The degree of anti-trans animosity in these red states is astounding, and appears very deeply rooted in their politics and not amenable to very much, except favorable court rulings
I always feel like I have to keep bringing this inconvenient fact up Refugee laws as the name applies only protect you if you are crossing the state line to stay, you have limited to no protection if you are going to the State for treatment and returning to your own state and because of the way many Red States have crafted their laws to use existing statutes Abortion travel = HOMICIDE , bringing your child to the state for gender affirming care is KIDNAPPING and CHILD ABUSE the Refugee state may unknowingly share information that you visited the state
We have to remember our resilience and resourcefulness as trans people. We got this far, against enormous odds. By "this far" I mean, we got to a place where we were even perceived as a threat, instead of a weird anomaly. Strange progress but real. The backlash was inevitable but it too, will go the way of the dinosaurs. These laws are not standing up to scrutiny. Let's not be discouraged. Thank you again Erin for your amazing work!
