Republican officials in Oklahoma, Louisiana, Florida, and South Carolina have directed schools to ignore Title IX rules passed by the Biden Administration.
President Biden’s response should be simple. If a state refuses to live by Title IX, then all public funding for that state will be withdrawn and available funding made possible by such states will be available to states that do obey the law.
If a state wishes to discriminate against Trans children, then let them pay for their own right to discriminate.
We'll have to see how it stands up in court. SC is one of those states that vehemently believes in state autonomy and state sovereignty. Just look at history. SC was the first state to succeed from the union over federal laws that infringed on state sovereinty.
If there's one thing I learned growing up in Christian school in the South in the 90s it's that pretty much since the Civil War onwards the South never turns down an opportunity to fight the federal government for the bigoted "right" to treat other humans like sub-human objects to be controlled, enslaved, or eradicated.
It's also a sad history lesson to see how the Republicans of the 1860s created and helped pass the Fourteenth Amendment... and now they want to destroy it. It's telling to see how which party supports bigotry and discrimination shifts over time, but which states support it never changes...
That was a different Republican party. Im not taking sides, but our country is still a republic based on democratic ideas. One nation comprised of 50 states, lead by a central government not ruled by one.
Of course, these are southern states doing this. I would’ve immediately known that was the case even if the title of Erin’s article hadn’t listed them. This is further evidence that the country is hopelessly, deeply polarized on trans issues. I don’t know how this ends but it’s not encouraging. Obviously, if these states insist on ignoring Title IX stuff from the federal gov’t, then there should be consequences, otherwise it just encourages other politically red states to do the same.
And, so it begins. See, I knew individual States would be defiant about anything that alters their trajectory with this bullshit. They're virtually making up their own Constitutional laws against the Federal Constitution. This experiment is failing miserably and I doubt President Biden has the backbone to crush those in violation of federal law. I sent him a message probably 2 months ago about all the hatred towards trans people, and here is his canned-response. SMFH

Dear Mr. Gibson,
Thank you for sharing your thoughts with me. Hearing from passionate individuals like you inspires me every day, and I welcome the opportunity to respond to your letter.
While the challenges we face are among the most difficult in our history, I have never been more optimistic for the future of America. Our Nation has always turned crisis into opportunity, and I believe we are better positioned than any country in the world to lead in the 21st century and deliver real results for the American people.
Even though we may not always agree on how to solve every issue, I will continue working to be a President for all Americans. I am confident that we can find common ground to make America a more just, prosperous, and secure Nation.
Sincerely,
Joe Biden

Does he think we're stupid enough to buy that kind of message full of buzzwords attempting to gloss over what I said? UGH!!!! I don't even remember what I said because website servers don't create paper trails these days. Web developers are getting lazier & lazier.
The Mississippi State Department of Ed did this several years ago after the Obama administration affirmed that Title IX included protections for trans students using bathrooms and locker rooms that match their gender identity. (Shocker, right?!) That is the reasoning our district uses to send our child to a teacher’s bathroom. We can file a Title IX complaint with the U.S. Department of Education, but when half of your household income comes from a school district, it leaves you in a bind.
I find myself wondering about the implications of these states' actions if we find ourselves under Republican rule starting in 2025. I live in California, considered a safe sanctuary state, but how safe will it be if Trump wins? Likewise for other "safe" states? I'm fairly certain that the politicians of Oklahoma, Louisiana, Florida, et al would respond with outrage if in 2025, sanctuary states refuse to follow federal laws under Trump (God forbid he wins!). But could whatever measures occur now in response to this "insurrection" be employed against "safe" states who try to protect their LGBTQ2S+ residents against authoritarian laws under Trump? Among other things, I think my question reflects what a terrible mess we are currently in in the USA.
Finally. Didn’t the Biden admin start working on this in 2020, and gave the official order to revise Title IX in 2021? And it doesn’t say anything at all about trans athletes.
In SC, Ellen Weaver will not be the person I vote for to lead schools. Giving license to bullying is not the message the superintendent needs to be sending.

That would include all Pell grants.
I hope the Biden Administration has the backbone to remove funding if the State does not comply with the law.
I worry that the outcome of the EMTALA case the Court just heard could strip the federal government of the ability to do that.
We'll have to see how it stands up in court. SC is one of those states that vehemently believes in state autonomy and state sovereignty. Just look at history. SC was the first state to succeed from the union over federal laws that infringed on state sovereinty.
Wow, as the parent of a Trans kid (20) I have to keep myself from saying incendiary things. So here....come for my child....come for me.

For now, yeah...

Yeah, sure, why not. Wouldn't be a day ending in Y if Republicans weren't being horrible little shitbags, would it?
We’ll just get rid of that pesky Supremacy Clause.

Rule of law? Yeesh. We work to change the law. They just throw it out the window. :(
