Judge Kacsmaryk, a federal judge in the Northern District of Texas, ruled on the EEOC's treatment of Title VII employment discrimination claims on gay and trans people.
The "drop the T" idiots are a loud but small minority of the queer community. Every queer person I know supports trans rights, both because that's the right thing to do and because they know their own rights are next in line.
It has begun. The time for civil disobedience is now. Time to use the shit out of the facilities that correspond with gender assigned at birth. Yes this is going to hurt but it’s where we’re at. No more indulging the fantasy of everything being ok. Looks like this broad is going to be shaving the 🐈in public.
Oh it’s war. To clarify public bathroom/locker room. They need to feel uncomfortable. Honestly, sports wouldn’t be an issue if we won in the men’s league, they would happily let us play in women’s divisions then. If they’re going to make us uncomfortable we can simply extend the favor. For too long, we assumed and demanded rights. It’s time to earn them
"Honestly, sports wouldn’t be an issue if we won in the men’s league, they would happily let us play in women’s divisions then."
I don't understand your logic here. Please enlighten, because Trans men participate and win, they are ignored. Also, I still fail to see how this could help.
I have generally avoided Trans activists who are extremely radical; making cis bashing statements, impossible demands, infighting and sabotaging incrementalism, mocking intersectionality. They have a value for certain times and places, and can be relied upon to provide "street theatre", but they'll never be invited to serious conversations with serious people where positive change becomes actualized. That requires a very different skill set, patience, diplomacy, relationship building, trust, and knowledge of opposing as well as congruent agendae.
I'm never going to stop my activism and advocacy, not even for death itself, but that doesn't mean I have to stand in the street with a bullhorn screaming at traffic.
Impossible demands, like what? You're really comfortable making incremental changes with fascists? Yikes. You are a radical activist whether you like it or not. Sorry, that's the state we are in atm. You don't get to pick. Please, stop wanting a seat at the table of white supremacy. You can't negotiate with fascists or their enablers and collaborators. But I guess you'll have to learn that the hard way.
I have a flight coming up in a month. It’s within the country. But I’m terrified of being harassed. I had issues a couple years back when I went through the scanner and the male agent looked at my privates said I would have to be searched and referred me to a female tsa agent. Thankfully she said, “you’re fine sir” and gave the other agent a disapproving look. What’s going to happen this time? This definitely doesn’t help.
Happened to me and I just looked perturbed enough that they didn't know what to do. LOL
Female agent looked at me like, "Sorry, sir." Male agent ran away when I told him I was wearing a packer. He said, "A what?" I said, "You know...,"looking down at my crotch. Took him about 10 seconds for his eyes to get wide and run away. 🤣
I forgot to say this was after him being all over my chest. He asked what was on my chest, and I told him it was a binder. Same question, to which he said, "Do you want the female officer to investigate." I said, "No, you already did that." That's when he asked was there anything else on my person he should know about. It was at that point I realized I had to get top surgery, no matter what it cost me. I had to pay out-of-pocket, because I can't get civilian insurance without giving up the VA entirely. They must be joking in this fucking country. I did get it, but paying out-of-pocket for bottom surgery is an entirely different story.
Hopefully this will be overturned on appeal. The Supreme Court makeup hasn’t changed much since Bostock so if this makes it there, we should get a favorable ruling, assuming of course that Roberts and Gorsuch haven’t changed their position on Bostock, which I haven’t seen anything yet to indicate they have.
Gorsuch wrote the Bostock decision, so in a sane world, he would react poorly to a district court judge overruling his decision. In this world . . . who knows?
Barrett is the change since Bostock as she was appointed before Ginsburg's body had chilled.
She's been a little reluctant to signal her hand on Trans issues and I don't know that I have a good read on employment and hiring. I feel she WILL vote against healthcare and would be a nay should Section 1557 of the 2010 ACA come before her, and I'm equally certain she would vote against federal legal recognition and public accomodation rights, but I'm hoping for better on education, employment, and government services.
That's far less than great, but if we could win 5-4 2 out of 5 vs. lose 6-3 5 out of 5, I'd take the former over the latter all day, any day.
I don't think we're going to escape the second Trump administration with very many federal rights intact and I think we're going to really seriously need to start thinking about how we can move the majority of our Trans and gender expansive community from red states to blue states. Trump is eager to prove he can force blue states to abandon us but so far his efforts to turn blue state Dems anti-Trans seem to be the major, perhaps ONLY thing maintaining Dem adhesion to our basic rights remaining a viable political objective for them.
Most of us live in red states and most of us can't afford to move, and many don't want to. Those of us in blue states need to start serious planning about finance and logistics to save as many of our red state Trans and queer sibs/fam as we can.
Now that we live in a post democracy era, separation of powers and checks and balances are no longer operative political paradigms. We can see this in the unitary executive arrogation of congressional powers and in its complete disregard for adverse adjudication.
That's how Matthew Kacsmaryk, who's just a Fifth Circuit MAGA justice in Plano, Texas, has more power than the GOPSCROTUS because he ALWAYS rules with Trump.
Trump has already promised him an SC seat next opening, though Trump is also considering expanding the Supreme Court and adding Aileen Cannon, Matt Gaetz, Matthew Kacsmaryk, and Mike Lindell as Supreme Court justices, bringing the number to 13 with a possible 10-3 split, though he believes Sotomayor and possibly Kagan will quit if he FUBARs the court in this way. Then we could see possible 13-1 splits.
They want to disrupt every progressive step forward, and dismantle every agency that protects civil rights. They wear the flag like a cape and wave the cross like a wand and think they'll make people disappear. Think again, bigots.
Pastor Martin Niemoller's poem titled First They Came is so very relevant. No one, who doesn't fit the MAGA image of a "normal" person, is safe. Gay rights, feminist rights, trans rights are all simply human rights at their core. As the pastor points out, it's easy to turn a blind eye, when it's not YOU they're after. It's not a popular view, I realize, but the 2nd amendment was written for just such circumstances. I'm not advocating violence, but we need to protect ourselves and each other. Clearly, "the system" isn't going to protect us.
Just a note here: MAGA’s “normal” is not safe if you are a person using contraception, IVF procedures, or having (involuntary) miscarriages. To be clear, there is nowhere that this persecution is not going to reach. *White males, don’t feel ‘left out’(i.e. safe), if you have a daughter who needed help/healthcare, you attend any kind of protest, you post “incorrect ideology” on social media, you marry an “incorrect” person, etc etc. Is it coming into focus yet?
Strange how the day after the 'procedural hearing' at the Supreme Court for district judges to NOT be allowed to put a nationwide injunction on maga bs is a corrupt GOP judge nationwide ruling on hate.
I swear they’re trying to hurt everyone they hate and also kill us all through the blood pressure or strokes all this news will bring. Jfc, I do not see how anyone anywhere can rule in favor of discrimination.
Yes. The potentially fatal effects of stress upon the bodies of members of persecuted and marginalized classes is called "allostatic load". The greater the allostatic burden, the greater potential for earlier fatalities like stroke, heart attack, suicide, and autoimmune conditions.
Trauma writes upon both the brain and the body, is cumulative, and in time, deadly.
This is why the US lack of access to quality and effective mental health care is a serious health issue directly related to our declining life expectancy.
This POS should be removed as a federal judge. He's bound by the holdings in Bostock and Harris Funeral Homes. He's not a f-cking little faux "Christian" dictator. NOTE: Just to be clear, by remove I mean impeached.
Explain to me (legally) how the harassing of any employee for any reason, to the point where they can't perform their job, isn't against the law?
Only when that employee is queer, of course.
I’d say the potential precedent here is harassment by (cis) men is ok because one of the “inherent differences between men and women”.
Same shit different day at this point
No, this is new shit. Or at least, shit that was "killed" 5 years ago now revenant.
The "drop the T" idiots now complaining the leopard eats their face.
The "drop the T" idiots are a loud but small minority of the queer community. Every queer person I know supports trans rights, both because that's the right thing to do and because they know their own rights are next in line.
The drop the T people may realise that is T can't be defended then it's going to be LGBT next on the hit list.
It has begun. The time for civil disobedience is now. Time to use the shit out of the facilities that correspond with gender assigned at birth. Yes this is going to hurt but it’s where we’re at. "Looks like this broad is going to be shaving the 🐈in public."
Please keep that metaphorical. I don't think doing that literally would help.
Oh it’s war. To clarify public bathroom/locker room. They need to feel uncomfortable. " sports wouldn’t be an issue if we won in the men’s league"
Some of us who are FtM do . . .
Yes but it doesn’t hit the same, just perpetuates the magic properties of testosterone which they believe make them superior.
Actually yes, pound for pound after a few years a FtM person under HRT will be as strong as a cisgender man. They compete and do well.
It's not magic, only biology.
The attitudes of SoCons are entirely parallel and not relevant to what I said.
Obviously, you disagree.
"Honestly, sports wouldn’t be an issue if we won in the men’s league, they would happily let us play in women’s divisions then."
I don't understand your logic here. Please enlighten, because Trans men participate and win, they are ignored. Also, I still fail to see how this could help.
Men think that testosterone is magical so if someone who is not on testosterone beats them they make excuses.
It would help because the perception is we’re competing against women because we can’t beat men. If we beat men then it’s not true.
I would volunteer to help. That might turn a few heads.
Does this also mean we can harrass people for being cishet?
Republicans want us all dead and Democrats are too scared and compliant to stop them. We are on our own.
Funny that, the radical activists have gone quiet not that we aseem to be losing. We no longer are useful to them now they have lost us equality.
I have generally avoided Trans activists who are extremely radical; making cis bashing statements, impossible demands, infighting and sabotaging incrementalism, mocking intersectionality. This is not a drill.
This is Reich 1934 time!
How are federal judges being allowed to rule against SC rulings? This can't be allowed to continue.
Now that we live in a post democracy era, separation of powers and checks and balances are no longer operative political paradigms. We can see this in the unitary executive arrogation of congressional powers and in its complete disregard for adverse adjudication.

Gorsuch authored Bostock!
