Wow, a hospital using ethics and protecting patient data, as well as trans kids. Maybe they should send a “How To Guide” to UC Berkley and a few others so they can learn how to find their backbones and not sell out their patients to a fascist government hell bent on exterminating us.
I wish they would send their ethics and patient protection-ness to Yale Hospital and Hartford Health hospital here in Connecticut. They both bent the knee the minute Orange Hitler threatened them.
IMO, the most concerning aspect of this subpoena is the demand for the names and addresses of trans patients. What would they want this information for? I fear they are databasing the trans community for later actions against us.
Massive privacy violation, you are correct to be alarmed about misuse in the future. This regime does not tolerate anyone not fitting their narrow and warped view of humanity.
While hospital records would indeed be helpful to the government in compiling a list of trans people, they will not be necessary. If your social security number is the same post-transition as it was pre; if you have applied for a gender change on your passport; if you earn wages and have filed tax returns under two different names that share the same social security number (which could include cis married women); there is already more than enough discoverable "self-incriminating evidence" that you are probably trans. The federal databases have been breached by DOGE and can be easily correlated. There are few limits on what they can do with this information, primarily because there is no longer fixed, constitutionally-based law in this country. Trump is the law. Like undocumented migrants, we can be declared undocumented, or to be using false documentation, thus a public danger and national security threat. Banks and financial institutions can be easily alerted as to their financial and possible legal risks of doing business with fraudulent identities, perhaps even threatened with adverse government actions for continuing to do so.
What you say is true. However, the most powerful/complete databases are constructed from data merged from multiple sources. If I were the evil scum in charge of such an effort, I would just tell everyone to send as much data as possible - and I'd figure out how to organize it. If you have an excuse to grab data, grab it and send it. If in doubt about any data you already have, send it. I'd also request certain types of data.
I agree with you about how the data may be used against us. I will of course add the unthinkable - that this is their list of people they would round up if that part of the Project 2025 wet dream ever comes to pass.
I am absolutely certain you are correct about their wanting to render us essentially undocumented. That does make a person quite vulnerable in society. Undocumented people never have the luxury of stepping out of line, even a little. I remember one election when the BMV had my driver's license so mucked up that I couldn't even vote.
Texas Tribune reported last year about Texas DPS requesting info for Texans trying or who already changed their gender markers and even names. They could not get an answer as to why Paxton made DPS gather this info and if they got all of it and what they want to do with it.
And many adults were treated as children prior at various targeted hospitals, so presumably their charts indicate they continued on as adult patients. Or did these other, compliant hospital systems just pass the entire charts along including the care they’ve received as adults?
Thanks S Baum! To me this highlights the truth of what is happening. The government says it is doing something for the purpose of protecting people. But it is a dog whistle. They are attempting to veil their hateful agenda in acceptable language and too often are given a pass. I am so grateful this Judge had the audacity, clarity and courage to call it out. May we build on instances like this.
Hope Kaiser here in the Bay Area has the guts to fight back! They already gave up treating trans kids! And wondering what next! I’ve been told by my friends there at the Gender Care that they are dedicated to continuing to provide care for the rest of us but how can you feel confident when they caved so easily to abandoning our younger brothers and sisters ⁉️ If enough providers just said hell no and dragged them through the courts maybe we could break this EO crap! There is no authority for an EO against us! We are not a hostile force trying to take over the country!
"No" is the correct response! We must continue to say "No!" and support others who do the same. This is going to be a long battle (started so very long ago) for the freedom of all of us to be who we are supposed to be. Thanks S. Baum for your reporting/investigating!
Even if you don't care about LGBT rights you'd think that the GOP, which claims to care about "states rights" and "government spending", would care about the large amounts of money spent just to harass a tiny minority.
They don't care about "states rights." That was always code for allowing racist and misogynist discrimination. Just like "small government" and was code for eliminating safety nets and social services, also rooted in racism and misogyny. They don't believe in any of the th9ngs they claim to and never have.
If shitler and the government keep trying these frivolous law suits to intimidate people, states and hospitals ect and losing in court as much as they do, what is the repercussions of that action to stop republicans from trying it again and again and again until they succeed? Is there a penalty, cost, an un-motivator ? If not why would they ever stop trying?
Frivolous lawsuits and countersuing legitimate suits are useful devices and have been part of Trump's MO since before he entered politics. They won't stop trying. Even failed attempts have the intended effect of frightening and demoralizing people, wearing them down. All they need to do is get a case to SCOTUS. On the chance that it fails there, all they need do is reformulate their argument to conform to the reasoning behind the decision, then bring it back to SCOTUS. SCOTUS is unlikely to hinder long term the Christian nationalists who ultimately control Trump.

COWARDS!
Thank you, Erin! Love reading your well-researched, truthful writings.
Kudos to S. Baum, who wrote this one.
Thanks for letting me know! Apologies for missing that.

Interesting that they wouldn't even answer that simple question. It tells me that the answer is illegal, possibly unconstitutional.
Kudos and thanks to Boston Children’s for having the courage and guts to do what was right instead of what was easy!
Was the subpoena also inclusive of trans adults at BCH? Plenty of adults also receive GAC there.
And many adults were treated as children prior at various targeted hospitals, so presumably their charts indicate they continued on as adult patients. Or did these other, compliant hospital systems just pass the entire charts along including the care they’ve received as adults?

Let's be sharks!

It’s wonderful that the legal establishment is not allowing these illegal requests for personal health information to be stopped
It is Imperative that this continue at every level of the justice system This is a violation of a persons right to privacy’

Yes! Resistance! Love to see it. Never comply in advance.
Or ever.
Thank you so much for this update, S. Baum. Hoping Children's National will follow suit.
Excellent job of reporting and analysis. So happy that Erin has help, and so happy that the help is excellent!!!

It's nice to get some good news!

I understand why they do it, I don’t understand why there is no penalty for them to continue to bring these frivolous law suits.
